Relies on Benton v. Moore

Decided 2000-08-30

PER CURIAM.

¶1An order merely granting a motion to dismiss is not an appealable, non-final order or a final order. See Benton v. Moore, 655 So.2d 1272 (Fla. 1st DCA 1995). As such, this appeal is dismissed without prejudice for lack of jurisdiction.
