Moore v. State

District Court of Appeal of Florida

Decided November 29, 2000

District Court of Appeal of Florida · decided 2000-11-29

Relies on Huff v. State

Decided 2000-11-29

¶1CONFESSION OF ERROR

PER CURIAM.

¶2Charles Moore challenges the denial of his motion for post-conviction relief upon the grounds that the motion was untimely. The state properly concedes that the motion was timely filed within two years of the date of the mandate in his direct appeal. See Huff v. State, 569 So.2d 1247 (Fla.1990). Accordingly, the denial of the *1292motion is reversed and remanded for consideration of the merits of Moore’s claim.
