¶1I would affirm the judgment. In my view the instructions given were intelligible and adequate for this case. I find no miscarriage of justice. (See Cal. Const., art. VI, § 13; People v. Watson (1956) 46 Cal.2d 818, 836 [299 P.2d 243].)
¶2Respondent’s petition for a hearing by the Supreme Court was denied May 11, 1978. Clark, J., and Richardson, J., were of the opinion that the petition should be granted.
