¶2Pursuant to the Alabama Supreme Court’s opinion in Ex parte Looney, 797 So.2d 427 (Ala.2001), the judgment in this case is reversed, and the cause remanded to the trial court for proceedings consistent with that opinion.

¶3REVERSED AND REMANDED.
