8 Misc. 520

Warren v. Chase

City of New York Municipal Court · decided 1894-05-15

<p>Disbursements are not taxable where the plaintiff recovers judgment for nominal damages only in an action specified in subdivision 3 of section 3228 of the Code. ■</p>

Decided 1894-05-15

McCarthy, J.

¶1The decisions are uniform that disbursements as allowed by law were always allowed by law as costs to the party entitled' to recover costs.

¶2They cannot, as in this case, exceed the damages. Code Civ. Proc. § 3228, subd. 3.

¶3We are clear that the justice erred in allowing the insertion of the disbursements in this case.

¶4The plaintiff, having recovered six cents damages, was only entitled to six cents costs, no matter what might be his disbursements.

¶5The order appealed from should, therefore, be reversed, and the clerk’s taxation reinstated and affirmed.

¶6Ehrlich, Ch. J., and Van Wyck, J., concur.

¶7Order reversed and the clerk’s taxation reinstated and affirmed.
