Johnson, Mason and Willard, JJ.,

¶1concurred with Judges Gardiner and Jewett, in favor of the reversal of the decree of the supreme court and the affirmance of the decree made by the Vice Chancellor.

Morse and Taggart, JJ.,

¶2dissented and were in favor of an affirmance of the decree of the supreme court.

Ruggles, Oh. J., gave no opinion. '

¶3Decree of the supreme court reversed, and that of the Vice Chancellor affirmed.
