State v. Desselle

Louisiana Court of Appeal

Decided October 10, 2001

Louisiana Court of Appeal · decided 2001-10-10

Decided 2001-10-10

FITZSIMMONS, Judge,

¶1concurring, with reasons.

¶2I respectfully concur in the result. The trial court imposed the sentence as a punitive measure for defendant’s failure to heed the court’s warning and comply with the court’s order. Suspension or delay in the execution of the sentence did not change the character of the sentence from punitive to remedial.
