People v. James

Appellate Division of the Supreme Court of the State of New York · decided 1981-05-21

Decided 1981-05-21

Kupferman, J.,

¶1concurs in the result in a memorandum as follows: I concur in the result. This is a bizarre situation in which, ostensibly because liquor was being sold in an after-hours club, the police entered the premises with shotguns and barred the exits. There was no rational basis for the search, and I concur in granting the motion to suppress.
