¶2I join in the decision of the Court, but express no opinion on the legislative intent behind the Medical Liability and Insurance Improvement Act (Tex.Civ.Prac. & Rem. Code Ann. art. 4590i, § 10.01 (Vernon Supp. 1991), or the comments about the decision in Morrison v. Chan, 699 S.W.2d 205 (Tex.1985), found in footnote 1 of the majority opinion.
