¶1concurring specially.

¶2I concur in the dismissal. I write separately to note that the juvenile court was without jurisdiction to enter a final judgment confirming the referee’s findings during the pendency of the father’s appeal. See R.H. v. J.H., 778 So.2d 839 (Ala.Civ. App.2000).
