¶1On Remand from the Alabama Supreme Court
¶2On the authority of Ex parte Appleton, 828 So.2d 894 (Ala.2001), the judgment of the trial court is reversed and this cause is remanded for proceedings consistent with the Supreme Court’s opinion.
¶3REVERSED AND REMANDED.
