Smith v. Dewalt

U.S. Courts of Appeals

Decided December 23, 2003

U.S. Courts of Appeals · decided 2003-12-23

Applies 28 U.S.C. § 2241 (Antiterrorism and Effective Death Penalty Act of 1996)

Decided 2003-12-23

*561 PER CURIAM.

¶1 Affirmed by unpublished per curiam opinion.

¶2 Unpublished opinions are not binding precedent in this circuit. See Local Rule 36(c).

¶3 Pete Smith, a federal prisoner, appeals the district court’s order denying relief on his petition filed under 28 U.S.C. § 2241 (2000). We have reviewed the record and find no reversible error. Accordingly, we affirm on the reasoning of the district court. See Smith v. Dewalt, No. CA-03-709-5-BO (E.D.N.C. Sept. 25, 2003). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the court and argument would not aid the decisional process.

¶4 AFFIRMED
