¶1Upon consideration of the petition for rehearing in this cause directed to the opinion and judgment herein of September 16, 1955, it is ordered that the petition for rehearing be and the same is hereby granted and the opinion and judgment aforesaid is hereby receded from, set aside and vacated.
¶2It is further ordered that the respondents’ motion to quash the alternative writ is denied.
