The Court finds that no prejudicial error intervened in the judgment and proceedings in the district court, and that the district court lacked jurisdiction pursuant to United States of America, v. Sarduy (6th Cir. No. 87-5540, January 29, 1988); it is therefore ORDERED that said judgment be, and it hereby is, AFFIRMED.
