¶1The matter of petitioner’s resentencing pursuant to Heggs v. State, 759 So.2d 620 (Fla.2000), and his consequent departure *1267sentence has, in fact, been reviewed by this court in both of petitioner’s previous appeals to this court. We therefore deny the petition for belated appeal.
