But whether they did so or not, whatever their motive or intent may have been, so long as the securities covered no more than the amount of their just and honest claims against Mann, they have a right to the full benefit of such securities, unless the giving of these three mortgages upon the same day to separate parties can be declared, in law and in fact, to be a common-law assignment of all the debtor’s property for the benefit of all his creditors.
