¶1Dissenting Opinion by

Judge Colins :

¶2I must respectfully dissent with the conclusion reached by the majority. The Pennsylvania Rules of Criminal Procedure and the constitutional guarantee of a fair trial provide an adequate remedy at law for the harm which petitioner alleges.

¶3I agree with the majority opinion insofar as the discussions in Parts II, III, IV and V.
