¶1 I concur, but if the defendant had exhausted his peremptory challenges, I should be inclined to sustain the eighth exception.

Per Curiam.

¶3 Upon careful consideration of the petition herein,

¶4 16 Ordered, That the petition be dismissed and the stay of remittitur revoked without prejudice to appellant, when called upon to say why a new day should not be assigned for the execution of the sentence heretofore imposed upon him, to plead that he is then insane, and to have that plea determined in the proper manner.
