¶2We grant the State’s motion for rehearing and vacate our opinion of January 28, 2004. Based upon the facts of this case, we deny the petition alleging ineffective assistance of appellate counsel. See Roberson v. State, 841 So.2d 490 (Fla. 4th DCA 2003).
