¶2This court has not previously determined that certain portions of the Supreme Court's analysis in Ex parte Couch, 521 So.2d 987 (Ala. 1988), are properly viewed as dicta, and I see no need to make that determination in order to decide the present case. Because I am not prepared to agree with this and other aspects of the main opinion's analysis, I concur only in the result reached by that opinion.
