ROTH, P. J.

¶1I concur in the judgment.

¶2In my opinion although the precise question has not been decided, appellant’s motion to suppress the revolver as the product of an illegal search and seizure is mandated by the legislative history and the clear terms of Penal Code section 1538.5. The error denying suppression, however, was, in the case at bench, not prejudicial.
