Bell v. Douglass

Tennessee Supreme Court

Decided July 1, 1830

Tennessee Supreme Court · decided 1830-07-01

Trespass, for entering a Smith’s shop and taking a sett of blacksmith’s tools, whilst the smith was using them.— The tools were levied upon by virtue of an execution, issued by a justice peace, upon a judgment obtained against Bell (the smith.)

Decided 1830-07-01

Per Curiam.

¶1The only question is, can the tools of a mechanic be levied upon whilst he is using them? The writ of fieri facias may be levied on all the goods of the defendant, (except his wearing apparel, or other articles excepted by the statute,) as well implements of trade, as others. Com. Digest, execution, ch. 4. The judgment must be rendered for the defendants.

¶2Judgment accordingly.
