¶1concurs in this dissent. He would also reverse on an additional point. Port intentionally shot two patrons of Stel’s Diner. He was charged and convicted for these acts. It was double jeopardy to convict him of wantonly endangering other patrons in the vicinity by the same acts for which he was convicted of murder.
