¶2My review of the whole Record convinces me that the Record supports the Durham City Board of Education’s decision to terminate plaintiffs employment as a teacher; that its decision was not made upon unlawful procedure nor affected by any other error of law; and that its decision was not arbitrary or capricious. I therefore respectfully dissent from Part I of the majority opinion and vote to affirm the judgment of the Superior Court.
