¶1 dissenting.

¶2 I respectfully dissent from the majority’s finding that substantial evidence exists to support the trial court’s determination that appellee was coerced and “in custody” and, therefore, was entitled to be informed of his constitutional rights. Considering the nature and the source of the testimony on this issue, the decision of the Wood County Court of Common Pleas should be reversed.
