Appeal from the United States District Court for the Eastern District of Virginia, at Norfolk. John A. MacKenzie, Senior District Judge. (C/A No. 89-465-N)

Ronald Lee Simmons, Sr., appellant pro se.

Robert Harkness Herring, Jr., Assistant Attorney General, Richmond, Va., for appellee.

E.D.Va.

DISSMISSED.

Before SPROUSE and WILKINS, Circuit Judges, and BUTZNER, Senior Circuit Judge.

PER CURIAM:

1

Ronald Lee Simmons, Sr. appeals from the district court's order refusing habeas corpus relief pursuant to 28 U.S.C. Sec. 2254. Our review of the record and the district court's opinion accepting the recommendation of the magistrate discloses that this appeal is without merit. Simmons v. Murray, CA-89-465-N (E.D.Va. May 4, 1990). Accordingly, we deny a certificate of probable cause and dismiss the appeal. We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.

2

DISMISSED.
