National Real</underline></bold><bold><underline>Estate Investment, LLC</underline></bold>: <bold><underline>Mortgage</underline></bold> — <bold><underline>Foreclosure sale</underline></bold> —<bold><underline>Redemption right</underline></bold> — <bold><underline>judgment lien</underline></bold> — <bold><underline>satisfaction.</underline></bold> Defendants Wyse Financial Services, Realamerica Ventures, and Irvin Borenstein, sought review of the court of appeals judgment in <underline>National Real Estate Investment, LLC, v. Wyse Financial</underline><underline>Services, Inc.</underline>, <cross_reference>66 P.3d 111</cross_reference> (Colo.App. 2003), reversing the summary judgment of the district court. The district court quieted title to a residential property in Realamerica, the purchaser at a foreclosure sale, despite the prior recording of a redemption certificate by National Real Estate. The district court held that although National, as the assignee of a judgment creditor, tendered redemption funds to the public trustee and both received and recorded a certificate of redemption, Realamerica, on behalf of the judgment debtor, was entitled to, and did, satisfy the judgment prior to expiration of National's redemption period, thereby extinguishing National's right to redeem. The court of appeals reversed, holding it to be within the discretion of the public trustee to issue a certificate of redemption to a lienor immediately upon payment of the redemption amount, and concluding that once the public trustee issued the certificate to National, its right to redeem could no longer be extinguished. The supreme court affirmed the court of appeals, but on slightly different grounds. Because the redemption by National actually occurred, according to § <cross_reference>38-38-303</cross_reference>, 10 C.R.S. (2001), upon payment of the required redemption amount to the public trustee and at that point National became statutorily entitled to a certificate of redemption, its right to redeem could not be extinguished by any subsequent satisfaction of the judgment.<page_number>Page 919</page_number>
