¶2I respectfuUy dissent.
¶3The cheek was tendered as final and fuU payment of monies owed to Cranor. Cranor knew when he cashed the check that it was so tendered. There was accord and satisfaction as a matter of law. McKee Construction Company v. Stanley Plumbing & Heating Company, 828 S.W.2d 700 (Mo.App.1992) [4-6].
¶4I would reverse the judgment.
