¶1The petition is granted and petitioner shall be. allowed belated appeal of the *604March 10, 2006, order denying motion for post conviction relief in Duval County Circuit Court case number 16-1997-CF-9101-AXXX. Upon issuance of mandate in this cause, the circuit court shall treat this court’s mandate as the notice of appeal. Fla. R.App. P. 9.141(c)(5)(D).
