Rothstein, from a judgment of the Court of General Sessions of the Peace in and for the city and county of New York, entered on the 12th day of November, 1903, convicting the defendant of the crime of grand larceny in the first degree in obtaining goods under false pretenses.

¶1I dissent from the affirmance of the judgment in this case, and vote for reversal for the reasons stated by Mr. Justice Gaynor in People v. Rothstein (42 Misc. Rep. 123), delivered upon granting the stay of: proceedings herein.
