¶1I concur in the judgment and generally in the opinion except for the part discussing the requested instruction on identification. I would also hold that it is error to refuse to give such an instruction upon request (see People v. Hurley (1979) 95 Cal.App.3d 895 [157 Cal.Rptr. 364], Hopper, J., dis.).
