¶1(concurring). I agree that the decision of the court of appeals should be affirmed. I do not agree that this record satisfies the subjective prong of the State v. Prober, 98 Wis.2d 345, 365, 297 N.W.2d 1 (1980), test. On the facts before us, I would employ the analysis used by the court of appeals, see State v. Kraimer, 91 Wis.2d 418, 283 N.W.2d 438 (Ct. App. 1979), to decide this case.
