Edward A. Ganey, Jr. seeks to appeal the district court's order denying his Fed. R. Civ. P. 60(b)(6) motion to vacate an order denying his motion to intervene. Our review of the record and the district court's opinion discloses that this appeal is without merit. Accordingly, we grant leave to proceed in forma pauperis and affirm the appeal on the reasoning of the district court. Ganey v. Ward, No. CA80-414-C-C-M (W.D.N.C. Jan. 27, 1993). We dispense with oral argument because the facts and legal contentions are adequately presented in the materials before the Court and argument would not aid the decisional process.

AFFIRMED
