Personalty

Personal property; the antithesis of real property. Personalty signifies generally any personal property, in contradistinction to realty, which signifies real property. In our old law, an action was said to be in the personalty wlien it was brought for damages out of the personal estate of the defendant. Personalty is either pure or mixed. Pure personalty is personalty unconnected with land; mixed personalty is a personal interest in land, or connected therewith. The distinction is important with reference to the statutes of mortmain, as pure personalty is not within the operation of those statutes. Mosleij Sf W.
