Secundum allegata et probata
According to what is alleged and proved. This phrase is used in expressing the rule that a party must recover, if at all, and a decision must proceed, upon the allegations and the evidence, not upon matters which are not pleaded, or not admissible under the pleadings; nor upon matters within the knowledge of the judge or jury, but not in evidence; nor upon facts which, though proved, do not make out the cause of action, or the defence alleged in the pleadings.
