To pursue, for a fraudulent purpose, a course which resembles, but is not, a transaction or condition of things from which the party might derive benefits or rights. Thus to simulate a disease, or an attack of insanity, is to feign the symptoms and imitate the behavior characteristic of either, with the purpose, for example, of escaping military duty, or founding a defence to a prosecution. A simulated sale is a transaction carried through by collusion, which presents the outward appearance of a sale, while, by the real intention, no transfer of the property is to be made; with the purpose, for example, of protecting the property against claims of creditors.
