A Dictionary of Law
Omission or forbearance to do a thing that can be done or that is required to be done. Does not generally imply carelessness or imprudence; simply, an omission to do or perform some work, duty, or act.
Willful neglect
An intentional failure to perform a manifest duty in which the public has an interest, or which is important to the person injured, in either preventing or avoiding injury. See Fault; Negligence.
