He is the prevailing party, within the meaning of a statute entitling such party to costs, who prevails on the main issue, to a greater extent than admitted by his adversary, though not to the full extent of his claim. 3 To be a prevailing party does not depend upon the degree of success at different stages of the suit; but whether at the end of the suit or proceeding the party who has made a claim against the other has successfully maintained it.* See Costs.
