A Dictionary of Law
A combat in which both parties enter willingly is " mutual." A person who enters into a combat armed with a concealed deadly weapon may use it to protect his life, if his adversary, who struck the first blow, resorts to such a weapon; and he will not be guilty of assault with intent to murder unless he intended from the first to use the weapon if necessary to overcome his antagonist.^
