Where three or roore persons meet to do an unlawful act upon a common quarrel, as, forcibly breaking down fences upon a right claimed of common or of way, and make some advances toward it.i A disturbance of the peace by persons assembling together with an intent to do a thing which, if executed, will make them rioters, and actually making a motion toward the execution thereof.
