Aut Clam

In the civil law. An action which lay where one forcibly or clandestinely, (vi aut clam,) erected or demolished a boilding on his own or another's ground, and thereby unlawfully injured another; its object being to get everything restored to its former condition, and to obtam damages.* Digi. 43. 24. 1. Bracton gives this action a place in his system of remedies, defining it as one which lay a^inst him who had erected or prostrated a building on another's land, and concealed himself in order to avoid being prevented from doing it, {et se occuliavit, ne sibi prokiberetur;) and observes that the offender might by this action be compelled to restore everything to its former state, at his own expense.
