Beasts of the plow, which, at common law, were privileged over other cattle. AVERIA OTI08A. Idle beasts; as distinguished from averia carucae, beasts of the plow. AVERIIS CAPTI8 IN WITHERNAM. In English law.. A writ which lies in favor of a man whose cattle have been unlawfully taken by another, and driven out of the county where they were taken, so that they cannot be replevied. It issues against the wrongdoer to take his cattle for the plaintiff's use. Reg. Brev. 82.
