Irregular Deposit

A Dictionary of Law · Henry Campbell Black · 1891

A Dictionary of Law

A species of deposit which arises when a party, having a sum of money which he does not think safe in his own hands, confides it to another, (e.g., a bank,) who is to return to him not the same money, but a like sum, when he shall demand it. An irregular deposit differs from a mutuum simply in this respect: that the latter has principally in view the benefit of the borrower, and the former the benefit of the bailor.

Story, Bailm. § 84; Poth. du Depot. 82, 83.
