It is now settled according to the dictates of common sense and humanity, that a child en ventre sa mire for all purposes for his own benefit,- is considered as absolutely born; Swift v. Duffield, 5 S. & R. (Pa.) 40. If an infant is born dead or at such an early stage of pregnancy as to be unable to live, it is to be considered as never born; Marsellis v. Thalhimer, 2 Paige, Ch. (N.
