When a thing is to be "deemed" something else, it is to be treated as that something else with the attendant consequences, but.it is not that something else; CO L J. Q. B. 380. When a statute enacts that something sball be deemed to have been done, which in fact and truth was not done, the court is bound to ascertain for what purpose and between what persons the statutory fiction is to be resorted to; 50 L.
