Bouvier's Law Dictionary and Concise Encyclopedia

Words used to describe a suit. Judgment, or decree in which the nominal plaintiff sues for the benefit or advantage of another. This is necessary in some cases where an assignee is obliged to sue in the name of the assignor. The style of the suit for consumption; the former being those in which the article bailed is to be used and returned and the latter those in which it may be consumed and returned in kind.
