Lat. [from aedes, a house, and facere, to build.] To make, or build a house; to erect a building. Aedificare in tuo proprio solo non licet quod alteri noceat. It is not lawful to build on your own land what may injure another.

3 Inst. 201.

A person has no right to erect a building on his own land which interferes with the due enjoyment of adjoining premises, and occasions damage thereto, either by overhanging them, or by the flow of water from the roof and eaves upon them; unless a legal right so to build has been conceded by grant, or may be presumed by user, or by the operation of a statute.
