Cowell It derived its name from the circumstance of being framed under the authority of the statute of Westminster 2, c. 24, which provided that "as often as it shall happen in chancery that in one case a writ is found, and in a like case^ {in consimili casti,) falling under the same right, and requiring like remedy, no writ is to be found, the clerks of ihe chancery shall agree in making a writ," Ac. 3 BL Com. 50.
