Day

[Lat. dies.] In practice and pleading. A particular time assigned or given for the appearance of parties in court, the return of writs, &c. See Days in bank, Dies datus, Return day. It was only by means of days thus given that a suit anciently could be continued in court; and where a day was not given it was equivalent to a discontinuance, and the suit came to an end. A defendant was said to go without day, (sine die) when he was finally dismissed from court. See Continuance, Sine die, Without day.
