Lat. To gain or acquire strength, force or validity; to become valid. Convalescit donatio facta a furioso; a gift made by a lunatic becomes valid, &c. Bract. fol.

Ex charta de confirmatione subsequente convalescit prima charta de donatione quae ab initio fuit invalida; the first deed of gift, which was originally of no effect, acquires validity from the subsequent deed of confirmation. Id. fol.

Quod ab initio non valet, tractu temporis non convalescet. That which is not valid at the beginning shall not acquire validity by course of time.

This maxim is almost in the same words with that of the civil law: Quod ab initio vitiosum est, non potest tractu temporis convalescere.
